OVERVIEW
This website is operated by Lend A Hen (LAH). Throughout the site, the terms “we," “us,” and “our” refer to Lend a Hen. LAH offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service,” “Terms”). These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website.
SECTION 1: GENERAL TERMS AND CONDITIONS
Participants hereby agree to indemnify and hold harmless Lend A Hen, their employees, officers, volunteers, agents and assigns from any loss or damage from any liability because of personal injury, property damage, or for claims of personal injury or death arising out of the participant's activities under this agreement. Participant agrees to be responsible for his/her own medical expenses that may result. Participant understands the nature of the activity and the risks involved. Participant voluntarily accepts those risks and assumes all risks of the participant's participation in this activity. Participant understands the legal consequences of agreeing to this document, including releasing LAH from all liability on all participants' behalf including children. LAH is not responsible for any damages, injuries or death incurred by the renting or buying of (including but not limited to) chickens, chicken coops, chicken supplies, or animal products.
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
A breach or violation of any of the Terms will result in an immediate termination of your Services.
SECTION 2 - BACKYARD CHICKEN & COOP RENTAL GUIDELINES
LAH rental packages include two adult egg-laying hens, one portable chicken coop, one poultry feeder and waterer, and enough feed and coop bedding to last the rental period. If customers choose to extend the rental period, they are responsible for notifying LAH through email at least two weeks prior to the end of their rental period. If the customer wishes for additional supplies to be delivered, our standard delivery rate of $25 will apply. If a customer chooses to purchase their own additional feed and bedding for the rental program extension, no discount will be given off of the rental extension price. If the need arises to return the rental package early for any reason, no refund will be given.
The customer is responsible for maintaining the health and well-being of the chickens. The chickens must always have access to clean water. In weather above 80 degrees F., the chicken coop must be kept in a shaded area. Once per week at least, we recommend moving the coop to a new location in the yard and we require that you replace the bedding. We recommend allowing the hens to "free range" around the yard under adult supervision. We require that someone must be nearby and supervise them while they're out of their coop. This will cut down on the chances that predators will take the chickens. Always contact LAH first if there are any problems.
Should any chicken suffer an injury or death due to an accident (e.g. a dog attack while out in the yard) please contact us by phone and email immediately. We will advise you what the best course of action will be, given the circumstances. Please do not take our chickens to a vet. We are normally able to nurse our chickens back to health. Customers will be charged a $100 chicken injury or replacement fee. We may be able to deliver a replacement hen, and the delivery will be subject to our standard delivery rates. Always contact us first if there are any problems.
The coop must be returned in a good, rentable condition, which will be determined by LAH. Each coop will be assessed when it is returned and a fair fee will be applied should there be any damage done to the coop. This fair fee is determined by LAH.
The customer is solely responsible for assuring that they/their yard meet any local/county/community regulations regarding the keeping of chickens on their property.
The customer is solely responsible for ensuring that the coop will fit through any gates or entryways into their yard where it will be kept for the duration of the rental period. If the yard has steps, a hill or other obstacles, like tree roots or ground ivy, that will hinder the coop wheels from rolling easily into it, someone who is able and willing to help lift the coop must be present at the time of delivery and pickup.
The customer is responsible for providing and installing any temporary fencing required to keep the hens contained to preferred areas of the yard.
SECTION 3 - DELIVERY POLICY
If a customer is located within the Treasure Valley area of Idaho, Lend A Hen will deliver the rental package to the customer as part of the rental fee. Rental packages are then picked up by Lend A Hen for no additional cost at the end of each rental period. If a customer wishes to return their rental package early for any reason, they are responsible for contacting LAH to request and schedule the package to be picked up by LAH on a date and time that works mutually for both the customer and Lend A Hen. Lend A Hen reserves the right to schedule deliveries and pickups within our pre-scheduled rental periods. Customers may request delivery of their rental to take place on a specific day or at a specific time, but requests are not guaranteed. Fulfillment of delivery requests depends solely on availability.
SECTION 4 - RETURN POLICY
Lend A Hen does not offer refunds for the early return of rental packages. If you cancel your rental at least one (1) week prior to the rental start date, based on availability, you may use 100% of the payment you made as a credit towards a future rental.
SECTION 5 - PURCHASE OF RENTAL PACKAGES
Following the rental period(s), the customer may choose to purchase the coop, hens, feeder or waterer for an additional charge: Mobile Chicken Coop: $975; the hens as a pair: $250 ($150 for one hen); feeder: $25; waterer: $25. The customer may choose to purchase items of the rental package separately or all together. Taxes will apply. To qualify for purchase of rental items, customers are required to complete their rental period. Rental fees may not be applied to the purchase of rental package items.
SECTION 6 - MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
SECTION 7 - PROHIBITED USES
In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.
SECTION 8 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 9 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
SECTION 10 - GOVERNING LAW
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United States.
